TERMS:

We accept Stripe and Paypal for online orders only.

We gladly accept Visa, Mastercard, AMEX, and Discover, VISA.

SHIPPING: 

WE DO NOT SHIP COD.

We ship WORLDWIDE.

Please allow 7 to 14 business days from the date that your order was placed for shipping.

Allow 14 or more business days for International orders.

All orders are shipped Priority through USPS.

If you have not received a tracking number by the 10th business day, please contact us.

We do honor expedited shipping requests for an additional shipping fee. Please contact us for expedited shipping requests.

Due to the nature of our business, we are not responsible for failing to meet requests outside of the 7 to 14 business day time frame.

Delays due occur due to manufacture issues, holidays, etc.

We ship using the address provided through Stripe and/or PayPal and at your time of checkout, please verify that the information is accurate.

We are not responsible for lost or stolen packages.

Once your order has been shipped and has arrived at USPS, refer to your tracking number and contact them directly for updates.

RETURNS: 

ALL SALES ARE FINAL.

No merchandise may be returned without prior authorization from customer service.

ALL COURSES, E-BOOKS, WORKSHOPS, CONSULTATIONS, MENTORSHIPS are NON REFUNDABLE

Customer is responsible for all return shipping charges (outgoing & incoming).

If an exchange is granted by customer service, additional shipping charges do apply.

Please do not send returns to our P.O. Box address until otherwise suggested.

No Chargeback

Customer agrees and understands that the charges on a credit or debit card or any other forms of payments are irrevocable, undisputable and may not be charged back, contested or challenged now or in the future, doing so is a material breach of this agreement for which Kay Cole Enterprises would be entitled to attorney fees, costs and fees associated with addressing a chargeback in addition to the amount challenged. Should Customer not pay the amount submitted to by Kay Cole Enterprises for the cost of the chargeback within 30 days after Kay Cole Enterprises has submitted its amount of cost due to Customer contesting a charge, the charges will be turned over to a collection agency. Kay Cole Enterprises shall have at its sole disposal any other legal remedy it independently chooses to pursue any collection against Customer for the cost of the chargeback. Customer further agrees that proof of purchase by Kay Cole Enterprises is all that is necessary to establish to the credit card agency or banking institution to deny a chargeback to Customer.

DAMAGES, DEFECTS AND DISCREPANCIES:

We carefully inspect all orders prior to shipping. However, it is the responsibility of the customer and/or authorized representative to thoroughly inspect orders upon receipt and report discrepancies to customer service.

FAILURE TO COMPLY WITH THE DAMAGES/ DEFECTS AND DISCREPANCIES POLICY CAN RESULT IN A DENIED CLAIM.

BACK ORDERS:

Due to the nature of our business, we are not responsible nor in control of back order items. Delays do occur from time to time due to items on back order status. If this is the case, you will be notified via email OR the info will be listed in the product description.

All in-stock merchandise is subject to prior sales. Availability is not guaranteed.

If merchandise is out-of-stock it will be back ordered, unless otherwise requested.

Mentorship Coaching Consulting

Please take the time to read and understand these terms and conditions (Membership, Coaching & Consulting Terms). They govern your (your or you) use of the Kay Cole Enterprises service as a member.

Once you sign “ I agree”, you agree to the Terms as a legally binding contract between you and Kay Cole Enterprises. If you do not want to agree to these Membership Terms, we’re sorry but our partnership will have to end there!

In these Terms, Content means all the content available through Kay Cole Enterprises including tutorials, courses, videos, eBooks, sample files and user forum content.

Eligibility Guidelines

Members must have at least 1 established business.

• You may find that you disagree with something that another mentees of the group has said.

• It is okay to disagree as long as it's done respectfully.

• Inappropriate behavior and/or language will not be tolerated.

• Please respect the authority of the Mentor.

• Keep on topic, but feel free to introduce information that is relevant to the discussion (statistics facts, industry details, best practices or related topics).

• All meetings will start on time.

• When you speak, please state your name.

• Some events will include food or beverages.

You are responsible for every use of all Resources. You must use reasonable efforts when networking and connecting with other mentees.

Your mentorship, or access to Content and Resources of Kay Cole Enterprises, will be suspended or cancelled if your monthly payments are unpaid.

You can ask for a refund of subscription fees, during the first 7 days of your subscription. You may also have rights granted to you by law which may entitle you to a refund of fees in specific circumstances. Apart from those things, refunds of subscription fees will not be made.

2. Payment Agreement Contract

MONTHLY PAYMENT MENTORSHIPS

Applies to mentorships where payments are made every month during the duration of the mentorship term.

You understand and agree that you have committed to a 3 to 6 month mentorship contract. And you agree to membership fees payable by you at the membership monthly rates at purchase time every month for a period of 6 months to access Kay Cole Enterprises.

Cancellation of Mentorship

You understand that you are able cancel your mentorship in the first 7 days for a full refund. Please email [email protected] to cancel. You understand that should you cancel your mentorship outside of the first 7 days, you agree to pay a cancellation fee equal to the total value of 3 monthly payments or the remaining value of your contract whichever is lesser.

3. Availability and Use of social media groups and platforms

All social media platforms and groups are available 24 hours a day, seven days a week. We may, however, need to approve post prior to posting.

When accessing and using these tools and its services and Content, you must comply with directions, instructions or protocols posted on the sites.

We are pleased to be able to offer a wide range of exclusive Content on various platforms for your educational and learning needs, which we aim to regularly add to. The Content will be updated, changed or removed from time to time, at our discretion, so we can’t guarantee that specific Content will always be available.

4. Rights to Content; intellectual property

Each item of Content is copyright of its author. We own any Kay Cole Enterprises contributed Content, and all other rights in the mentorship including its design, compilation and look and feel.

Your mentorship gives you a right (a revocable, non-exclusive license) to use the content for business purposes. You must not redistribute Kay Cole Enterprises content (such as tutorials, eBooks, videos, courses and source files). Any project files, spreadsheets or other assets associated with content of Kay Cole Enterprises are included to demonstrate the course or tutorial. You may use, modify and manipulate files for your own personal educational purposes, but you must not otherwise exploit the files and the assets in them, or redistribute the files or assets. If you love the content, please ask your friends to become mentees too!

You may freely use the procedures and techniques demonstrated in the Content (that is, the knowledge you gain) for any commercial or personal purpose.

The trademarks and logos displayed of Kay Cole Enterprises, unless otherwise stated, you must not use these without the approval of the Kay Cole Enterprises.

5. Fair use and prohibited conduct

You are permitted to download Content to your computer as part of your mentorship. But your membership is subject to a ‘fair use’ policy. Our ‘fair use’ policy requires that your use of Kay Cole Enterprises and the Content must be fair, genuine and reasonable. For example, the total amount of Content you download must be reasonable in light of your genuine education and learning needs, and the time needed to genuinely engage with the Content. We will use our reasonable discretion to decide whether a member has complied with the ‘fair use’ policy.

You also must not:

a. use a false email address, impersonate others, or misrepresent your affiliation with others;

b. insert advertising, branding or other promotional content into the Site or Content;

c. attempt to gain unauthorized access to computer systems or materials;

d. engage in automatic gathering of information from or through the Site (such as “spidering”, “screen scraping”, “database scraping” or harvesting of e-mail addresses);

e. attempt to interrupt or alter the Site’s operation in any way (for example through sending mass unsolicited messages, “flooding” servers, or introducing a virus, time bomb, trojan horse, worm, cancelbot or other computer routine );

f. use the tools, resources, and content in a way that violates applicable law, that violates third party intellectual property or other rights, or that is, fraudulent, obscene, offensive, or defamatory; or

g. except as allowed in these Mentorship Terms, copy, distribute, transmit, modify or otherwise exploit the Content or any other data or code made available through Kay Cole Enterprises.

6. Intellectual property complaints

We respect the intellectual property rights of others and require that you do the same.

Please contact us if you believe that your intellectual property or other rights are being affected.

If you are specifically making a copyright-based claim, please forward the following information to us:

a. your address, telephone number, and email address;

b. a description of the location of the alleged infringing material;

c. a description of the copyright work that has been allegedly infringed; and

d. a statement by you that you warrant that the information given in your claim is accurate and that you are either the copyright owner or are authorized to act on the copyright owner’s behalf.

7. Forum and community rules

Please read our Forum and Community rules, which are part of these Mentorship Terms and apply to content contributed to the Sites by members (such as comments, reviews and forum posts).

We reserve the right, but are not obliged, to monitor all matter posted to the Site. We are not responsible or liable for material posted by others. We do, however, reserve the right to edit, refuse to post or to remove matter that in our discretion is objectionable or in violation of these Mentorship Terms, our policies or applicable law.

You must not upload or post any materials that:

a. restrict or inhibit others’ use or enjoyment of the Site;

b. are false, misleading, fraudulent, unlawful, abusive, harassing, defamatory, obscene, vulgar, or offensive;

c. infringe others’ rights, including privacy or intellectual property rights;

d. disclose personal information about others, particularly sensitive information;

e. contain a virus, spyware, or other harmful component; or

f. contain commercial solicitation or ‘spam’ of any kind.

8. Privacy

Our information collection and use of any personal information about you is set out in our privacy policy.

Personal information that you disclose may be used by Kay Cole Enterprises, its agents and contractors in relation to your membership, including marketing activities.

We may disclose any personal information as necessary to satisfy any law, regulation or government request.

9. Refusal, suspension or termination of membership

We may, in our discretion, immediately restrict, suspend or terminate your membership and access to Kay Cole Enterprises if we consider you in breach of these Membership Terms, any other Site rules, or applicable law.

We reserve the right to refuse membership in our discretion (examples include previous breaches of membership terms .

10. Liability and disclaimer

Except as provided in an applicable Non-excludable Law, we are bound only by the express promises made in these Mentorship Terms and are not bound by implied terms.

Except as provided in an applicable Non-excludable Law:

a. we do not promise that the Content or your access to Kay Cole Enterprises will be uninterrupted or error-free.

b. we make no promises regarding your access to, or the results of your access to, the content in terms of correctness, accuracy, timeliness, completeness, reliability or otherwise.

Except as provided in an applicable Non-excludable Law, we and our affiliates are not liable for indirect, incidental, special or consequential damages, loss or revenue or loss of profits which result from any use of or access to, or any inability to use or access of Kay Cole Enterprises.

c. we are not responsible for any communication, exchanges, deals, partnerships outside of our knowledge within Kay Cole.

d. authors are responsible for the collection and handling of all funds from their book sales, communication with buyers, shipping, returns, and product damages.

e. authors are responsible for travel arrangements and expenses for book tour participation.

11. Changes to Mentorship Terms

We may change these Mentorship Terms from time to time, but we will notify members before doing so. You will be given the opportunity to cancel your subscription with a pro-rata refund (based on time remaining in your subscription) if you do not want to accept the changes. If you do not opt out in this way, your continued subscription to and use of the Site will be an acceptance of the updated Membership Terms.

12. Applicable Laws

We control and operate Kay Cole. The laws of Georgia govern these Mentorship Terms, and you and Kay Cole Enterprises submit to the jurisdiction of the courts there.

Kay Cole EnterprisesStrategy Sessions

Kay Cole Enterprises strategy sessions are 1 hour with the option to add additional hours. All sessions are non refundable. With prior 24 hour notice rescheduling is permitted. If notice is not given prior and the call is missed. Client will have to repurchase strategy session.
